The initiator of the new bill on amendments to the Law of Ukraine “On Anti-Doping Activities in Sports” was the current Prime Minister Yulia Anatolyivna Svyrydenko .
The purpose of the draft law is to amend the Law in connection with the amendments to the 2027 World Anti-Doping Code and the International Standards made by the World Anti-Doping Agency (hereinafter referred to as WADA), which enter into force on January 1, 2027.
What is changing?
In addition to general amendments in accordance with international changes in the field of sports, the draft proposes to create a specialized state institution – the National Anti-Doping Center (NADC) – more recognizable to the global anti-doping community and to provide at the level of the Law the need to have doping control points at sporting events/competitions that meet WADA requirements. As well as to improve the powers and functions of the NADC, the Nomination Committee and the NADC Supervisory Board.
Separately, it is proposed to specify the criteria for persons who can carry out doping control with the creation of a legislative basis for stimulating and effective work of members of the Disciplinary Anti-Doping Commission, the Anti-Doping Appeals Commission, and the Therapeutic Use Committee, by establishing and determining their remuneration related to
their activities as part of the aforementioned commissions and committee.
Current problems
One of the problematic issues of anti-doping work is the lack of doping control points that meet the requirements of the International Testing Standard during the organization of sports competitions included in the Unified Calendar of Physical Culture and Recreation, Sports Events and Sports Competitions of Ukraine, which is why it is proposed to provide for this norm at the legislative level.
An important issue is the regulation of remuneration for persons involved in anti-doping activities as part of auxiliary anti-doping bodies. Article 43 of the Constitution of Ukraine stipulates that everyone has the right to work, which includes the opportunity to earn a living by work that he freely chooses or to which he freely agrees. The practice of leading countries in Europe and the world provides for remuneration for the activities of members of auxiliary anti-doping bodies at the level of national legislation.
The need to establish payments, according to the initiator of the bill, is also due to the fact that members of these bodies, in addition to the image component, also need financial guarantees for their activities, since there is a tendency for members’ interest in the work of such bodies to decline.
Payment for their activities is planned to be paid directly from the state budget, and the relevant expenses will be taken into account when forming budget requests for the relevant budget periods within the budget program KPKVK 1220 “Development of physical culture, high-achieving sports and reserve sports.”
Result
The expected result of the implementation of the draft Law is the creation of conditions for improving the work of both the National Anti-Doping Center itself and all involved bodies, individuals and organizations, the purpose of which is to combat doping in sports. According to the initiator, the adoption of the draft Law should also ensure compliance with WADA requirements for testing athletes, increase the authority of independent anti-doping bodies such as the Anti-Doping Disciplinary Commission,
the Anti-Doping Appeal Commission and the Therapeutic Use Exemption Committee, and increase competition at the stage of selecting candidates for membership. The criterion for effectiveness is the compliance of the Law of Ukraine with the provisions of the World Anti-Doping Code.
