What diseases are not accepted into the army after 50+ years in 2026: a complete list and analysis

Today , even after reaching the age of 50+, the likelihood of mobilization for men exists , although it is significantly reduced due to health problems that often make themselves felt at this age, but many men after fifty still worry: will they take me into military service with my illnesses?

In this article, based on a legal analysis of the practice of cases of recognition as unfit for health reasons and current legislation from the list of grounds, criteria and diseases specified by Order No. 402 of the Ministry of Defense of Ukraine of 2008 : we have compiled an up-to-date list of diseases with which, after 50+ years, a person is most often recognized as unfit or limitedly fit for military service (according to new changes from 2024 – suitable for the rear service of logistics, security, support, CCC and training centers).

The information presented in this material by the editorial office of Ukrainian Information is based on the current legislation of the Schedule of Diseases and the practice of military medical commissions (VLK). However, we understand and warn that the letter of the law does not always directly correspond to the reality of its application in practice. There are often excesses (deviations from the norm of the law) where it is necessary to appeal the decision of the VLK or seek help from military lawyers.

Why after 50 years the chances of mobilization are generally lower

Although there is a widespread myth in Ukrainian society about the alleged “ ban on mobilization of men after 50+ years of age ,” this is still a fiction that has long been refuted by military lawyers and even directly explained by the Ministry of Defense that there is no direct ban, because there is no legal norm that prohibits or stops mobilization for fifty-year-old men of the military registration category.

According to the law, after 50+ years of age, men are subject to conscription for mobilization, provided they are called up for mobilization needs and have passed the military service examination with the conclusion “fit” or “fit for rear service”. That is, in this case, the state of health plays a key role. After all, many chronic diseases that are considered “limitedly fit” at a younger age, after 50 years of age give grounds for recognition as unfit or temporarily unfit .

What diseases are most often not treated after 50 years of age?

The entire list of diseases where a person aged 50+ is subject to exclusion from the military draft due to health reasons in accordance with Part 6, Article 37 of the Law “On Military Duty and Military Service” is quite extensive and depends on many factors (degree of functional impairment, futility of treatment, number of surgical interventions and years of treatment), therefore, below is a list of the most common diagnoses by groups (cardiovascular, respiratory, musculoskeletal, vision, hearing, and others) with which men aged 50+ in 2026 receive unfitness due to health reasons and are excluded from the military draft, or have significant restrictions on further military service:

Cardiovascular diseases:

  • Hypertensive disease of II–III degree with crises;
  • Ischemic heart disease (tension angina, previous heart attack);
  • Heart failure of functional class II–III;
  • Arrhythmias requiring ongoing treatment.

Respiratory diseases:

  • Moderate to severe chronic obstructive pulmonary disease (COPD);
  • Moderate and severe bronchial asthma;
  • Pulmonary insufficiency.

Diseases and problems of the human musculoskeletal system:

  • Osteoarthritis of large joints with pronounced deformity;
  • Intervertebral hernia with neurological complications;
  • Ankylosis of large joints;
  • Rheumatoid polyarthritis.

Diseases of the endocrine system:

  • Type 1 diabetes with severe impact and problems with other organs;
  • Type 2 diabetes with severe complications;
  • Obesity of III–IV degree with a negative impact on other organs.

Diseases of the nervous system:

  • Stroke consequences with severe neurological disorders;
  • Epilepsy with frequent seizures;
  • Parkinson’s disease.

Oncological diseases:

  • Malignant neoplasms of any location (even after treatment or during treatment).

Other serious conditions:

  • Chronic renal failure;
  • Cirrhosis;
  • Gastric and duodenal ulcer with frequent exacerbations;
  • Mental disorders (schizophrenia, confirmed cases of suicide, other memory impairments and other abnormalities).

What to do if you have a chronic illness but no medical documents?

  1. Collect all new medical documents (extracts, epicrits, examination results, obtain an extract from the electronic medical register for the last 2–3 years) by undergoing independent medical examinations.
  2. Contact the CCC to receive a referral to the VLK or receive a referral to Reserve+.
  3. Pass a military medical commission (MMC) at the CCC or in a hospital, depending on the subordination and referral.
  4. In case of refusal, appeal the decision to a higher VLK or to the court independently or with a medical lawyer on VLK issues.

Important nuances for men 50+

  • After 50+ years, the commission more often takes into account general health and comorbidities.
  • The presence of even one severe chronic pathology significantly increases the chances of being declared unfit.
  • If there are several diagnoses of moderate severity, they are considered individually and in combination if there is a common impact.

Conclusion

After 50 years, the presence of serious chronic diseases significantly increases the chances of receiving unfitness and being discharged from the ranks of the Armed Forces of Ukraine if you are already in military service as a soldier. The main thing is to correctly collect medical documents and pass the VLK. Do not ignore your rights, contact military lawyers and do not forget to engage in treatment. Timely consultation with a doctor and annual recording of the diagnosis is the best way to protect yourself and prove unfitness or temporary unfitness .
