In accordance with the procedure of the Resolution of the Cabinet of Ministers of Ukraine No. 76 , which determines the possibilities of granting enterprises the right to reserve their own employees from mobilization in accordance with the Law of Ukraine “On Mobilization Preparation and Mobilization” , one of the requirements is the compliance of an LLC, PE, JSC or other enterprise with the criteria by which enterprises, institutions and organizations are determined as being critically important for the functioning of the economy and ensuring the livelihoods of the population in a special period .
These criteria by which an enterprise is recognized as critically important for the economy are determined by the relevant Ministry of Economy, Environment and Agriculture of Ukraine . These criteria include requirements for the minimum wage, income, number of employees, average wage, SSC taxes paid and other important economic indicators that have been revised since the beginning of the full-scale invasion.

New criteria for recognizing enterprises as critically important (according to Order No. 6954 of 06/24/2026)

According to the Order of the Ministry of Economy, Environment and Agriculture of Ukraine No. 6954 dated June 24, 2026, updated criteria have been established for determining enterprises as critically important for sectors of the national economy.
Below is an analytical detailed table with new changes and requirements so that you can understand whether your company falls under the new criteria to be recognized as “Critical to the Economy of Ukraine” and have the right to reserve its own employees. For ease of reading and analysis, we have divided the table by industry and specific criteria:

Important notes on sanctions and restrictions: For representative offices of foreign companies, a mandatory condition is the absence of international sanctions , sanctions in accordance with the Law of Ukraine “On Sanctions” , as well as a ban on any activity on the territory of the Russian Federation, Belarus and the temporarily occupied territories of Ukraine.
